AGREEMENT FOR TRANSFER OF ELECTRONIC INFORMATION
Project: SomeWhere Business Park
In accepting and utilizing the Site and Rough Grading Preliminary Plan dated 1-4-2010 provided in the form of electronic media, the undersigned covenants and agrees that all such drawings and data are instruments of service of [insert engineers company name here] who shall be deemed the author of the drawings and data, and shall retain all common law, statutory law and other rights, including copyrights. The undersigned further understands and acknowledges that if the drawing represents an initial submittal for project approvals and will not reflect any modifications required during the approval process nor represent actual as built conditions of the rough grading project. It is the developers’ responsibility to confirm any data that would represent their final pricing. The undersigned shall advise [insert engineers company name here] of any errors or discrepancies prior to their use of this information.
The undersigned further agrees not to use these drawings and data, in whole or in part, for any purpose other than the project for which is the subject of this agreement. The undersigned agrees to waive all claims against [insert engineers company name here] resulting in any way from the unauthorized changes or reuse of the drawings and data, for any other purpose, by anyone other than [insert engineers company name here].
The undersigned agrees, to the fullest extent permitted by law, to indemnify and hold harmless [insert engineers company name here] , it’s employees, Principals and agents, from any damages, liability or cost, including attorney’s fees and costs of defense, arising from any changes made by anyone other than [insert engineers company name here], or from any reuse of the drawings and data without prior written consent of [insert engineers company name here].
Under no circumstances shall the transfer of the drawings and data on electronic media for use by the undersigned be deemed a sale by [insert engineers company name here] and [insert engineers company name here] makes no warranties or guarantees, either expressed or implied, of the accuracy or completeness of the information as originally prepared, copied, transmitted or from conversion.
Use by the undersigned is at their sole risk.

Sample Site Preparation Cost

RE: SomeWhere Business Park – Lot 4 & 5 Site Preparation
The following is a breakdown and explanation of the costs associated with the grading of Lots 4 and 5:
1.) General Conditions — ($3,800.00) — this cost represents a 1.5% Bond Premium fee.
2.) Construction Survey / Layout — ($10,000.00) — is the cost associated with Construction Stakeout for the following items:
• Erosion and Sedimentation Control Facilities.
• Drilling and Blasting.
• Mass Rock Excavation Cut / Fill
• Final Grading of Lot 4 & 5, Access Road and Slopes.
Note: A double shift work construction operation is needed to meet the time frame of the project and also is reflected in the cost for Construction Survey / Layout.
3.) Construction of Erosion Control Measures — ($55,300.00) — is the cost for this item:
4.) Grubbing & Burying Stumps — (3)(Acre)($2,500.00) = $7,500.00 — this is the cost to excavate, load, haul, clean and grind stumps into wood mulch and haul off. Also, this unit cost is based from the original bid item.
5.) Mass Excavation and Grading—(100,000)(C.Y.)($6.00) = $600,000.00 – this item cost consists of Drilling, Blasting, Excavating, Hauling, Placing and Compacting Rock Fill. This Unit Price of $6.00 / C.Y. is establishment for the following reasons:
• Working double shift operations to help ensure no frost will set in rock fill material.
• Winter Conditions consisting of snow plowing and cindering for all access roads, haul
routes and all cut and fill areas of operations to ensure safe working conditions.
• Removal of frozen or unsuitable material not to be cut or filled upon.
• Increase in overhead and project management.
• Increased equipment maintenance and repairs during winter conditions.
• Increased fluid and fuel costs due to treatment additives for winter conditions.
• The cost of light plants and personnel for night shift operations.
The Total Costs for Lot 4 & 5 – Site Preparation = $676,600
